By accessing or using the Site, purchasing products, or using our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), including all policies referenced herein or available via hyperlink, such as our Privacy Policy and Warranty Policy. These Terms apply to all users, including browsers, customers, vendors, merchants, and contributors of content.

If you do not agree to these Terms, you may not access the Site or use the Service. We reserve the right to update these Terms at our sole discretion by posting changes on this page. Your continued use of the Site or Service after such changes constitutes acceptance of the updated Terms. It is your responsibility to check this page periodically for changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform for our products and services.

Prices and product descriptions are subject to change without notice. We may modify or discontinue the Service or any part thereof without notice. We are not liable for any modification, price change, suspension, or discontinuance of the Service.

SECTION 5 - PRODUCTS AND MATERIALS

Our products are premium jewelry items crafted from surgical-grade stainless steel with 18k gold plating. We strive to display product colors and images accurately but cannot guarantee your device’s display accuracy. We may limit sales to any person, region, or jurisdiction and restrict quantities at our discretion. All product descriptions and prices are subject to change without notice.

Lifetime Color Warranty: Carter & Bloom guarantees that our jewelry will not fade, tarnish, or turn skin green under normal use. This warranty entitles you to a one-time free replacement of the specific item that has tarnished. This warranty does not cover physical breakage, lost items, or damage caused by misuse. It is strictly a replacement warranty and does not offer cash refunds.

Product Safety: Our jewelry contains small parts (such as earring backs or clasps) which may present a choking hazard to small children. Keep jewelry out of reach of infants and small children. While our products are hypoallergenic and made from surgical-grade steel, we are not liable for individual allergic reactions that may occur due to specific sensitivities.

SECTION 6 - BUNDLES AND PROMOTIONAL OFFERS

A core part of our Service includes "Build Your Own Bundle" offers (e.g., "7 items for a set price"). By purchasing a bundle, you agree to the following:

  • All Sales Final: Bundles are sold at a deep discount. We do not accept partial returns or exchanges for individual items within a bundle unless an item is defective.

  • No "Change of Mind": Once a bundle order is processed, it cannot be cancelled or refunded.

  • Defective Items: If one item in your bundle is defective, we will replace that specific item. We will not refund the entire bundle.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse, limit, or cancel orders at our discretion, including those from dealers or resellers. We may notify you of order changes via the provided contact information. You agree to provide accurate, current, and complete purchase and account information and to update it promptly.

100% Satisfaction Warranty (Replacement Only):

Carter & Bloom stands by the quality of our products. If you receive a defective or damaged item, or if you are unsatisfied with the quality, you are eligible for a Replacement Warranty.

  • Strict No-Refund Policy: We do not offer cash refunds, chargebacks, or credit reversals. All "Satisfaction Guarantees" refer strictly to the right to exchange a defective product for a new, working unit.

  • Claim Process: You must contact us at hey@carterandbloom.com within 30 days of receipt to initiate a warranty claim.

SECTION 8 - PAYMENT TERMS

To place an order, you must provide valid payment information (e.g., credit card, PayPal, Google Pay, Shop Pay). You authorize Carter & Bloom to invoice your account for all fees and charges without additional notice or consent. You agree to notify us of changes to your billing information. We use third-party payment processors, and you consent to their terms and policies. Carter & Bloom is not liable for errors or breaches by third-party processors unless due to our negligence.

SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools or links "as is" without warranties or liability. Your use of such tools or third-party websites is at your own risk, and you should review their terms. We are not responsible for third-party content, products, or services or any harm arising from their use.

SECTION 10 - USER COMMENTS, FEEDBACK, AND SUBMISSIONS

Submissions (e.g., feedback, contest entries, photos of you wearing our jewelry) may be used, edited, or published by us without restriction or compensation. We may monitor or remove content we deem unlawful or objectionable. Your submissions must not violate third-party rights (e.g., copyright, trademark, privacy) or contain unlawful or malicious material. You are responsible for their accuracy, and we assume no liability.

Violation may result in termination of access.

SECTION 14 - MARKETING AND INTELLECTUAL PROPERTY

Our marketing materials are for informational purposes. Comparisons to other jewelry brands are based on objective material testing (e.g., "Solid Gold vs Gold Plated"). Carter & Bloom products are independently designed. Claims regarding "Waterproof" or "Tarnish-Free" are based on our specific 18k PVD coating process.

SECTION 15 - CONSUMER COMPLIANCE

We comply with applicable consumer protection laws. Our "Replacement Only" policy is clearly stated to ensure transparency. If a replacement cannot be fulfilled due to stock issues, we reserve the right to provide Store Credit equal to the value of the item.

SECTION 16 - REGULATORY COMPLIANCE

Carter & Bloom products are fashion and fine jewelry accessories. They are not medical devices and are not intended to cure or treat any condition. We comply with general consumer product safety regulations regarding lead and nickel content in jewelry.

SECTION 17 - FORCE MAJEURE

We are not liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, supply chain disruptions, governmental actions, or third-party service failures.

SECTION 18 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The Service and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose, except for the specific Lifetime Color Warranty expressly outlined in these Terms.

  • Limitation of Liability: To the maximum extent permitted by law, our total liability for any claim arising from the Service or products shall not exceed the replacement value of the product in question. We are not liable for any indirect, incidental, punitive, or consequential damages.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Carter & Bloom, our affiliates, officers, directors, agents, and suppliers from any claim, including reasonable attorneys’ fees, arising from your breach of these Terms, violation of law, misuse of our products, or infringement of third-party rights.

SECTION 20 - DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER

All disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Austin, Texas, under its Consumer Arbitration Rules. Arbitration shall be conducted by a single arbitrator, and the decision shall be final and binding. Each party shall bear its own costs, except as provided by AAA rules. Any claim must be filed within one year of the event giving rise to it, or it is barred.

  • Class Action Waiver: You agree to resolve disputes on an individual basis only and waive any right to participate in a class action, consolidated action, or representative action against Carter & Bloom.

  • Waiver of Jury Trial: You and Carter & Bloom waive any right to a jury trial for disputes arising from these Terms or the Service.

    If arbitration is unenforceable, disputes shall be resolved in the state or federal courts of Travis County, Texas, and you consent to exclusive jurisdiction and venue therein.

SECTION 21 - SEVERABILITY

If any provision of these Terms is unlawful or unenforceable, it shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain valid.

SECTION 22 - TERMINATION

These Terms are effective until terminated by you or us. You may terminate by ceasing use of the Service. We may terminate your access for any breach without notice, and you remain liable for amounts due up to the termination date. Obligations incurred prior to termination survive.

SECTION 23 - ENTIRE AGREEMENT

These Terms, along with referenced policies, constitute the entire agreement between you and us, superseding all prior agreements. Our failure to enforce any provision does not waive it. Ambiguities shall not be construed against the drafting party.

SECTION 24 - GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas.
